State of Idaho v. Westhafer, No. CRF 09-19308 (Kootenai County). Two-day felony DUI trial, resulting in a hung jury.
State of Idaho v. Frank, No. CR 08-15255 (Kootenai County). Charge of possession of marijuana. Case dismissed following granting of motion to suppress all evidence obtained against Defendant on illegal search and seizure.
Linde v. Linde, No. CV 07-403 (Kootenai County). Ten-day bench trial in defense of action for breach of fiduciary duties and other claims relating to the dissolution of a limited liability company, with decision of no liability on fiduciary duty claims.
Wilcox v. Anton, No. CV 09-8170 (Kootenai County). Respondent initially had a domestic violence protection order entered against him when he represented himself in a hearing in a case brought by his wife's former husband, alleging abuse of one of the wife's minor children. After a motion, briefing and hearing over the procedures employed, the protection order was vacated and set for re-trial. At the new trial, the case was dismissed.
Ennis v. Ennis, No. CV 02-1249 (Bonner County). Divorce trial of several days; my client, the mother, was granted sole legal and physical custody of the minor children and the right to move with the children to California. This case also involved contested issues of property and debt distribution, wasting of the marital estate, voluntary underemployment, and domestic violence.
Philbrook v. Philbrook, No. CV 02-0235 (Boundary County). Divorce and recurring custody litigation; trial in 2005 on a modification of custody petition resulted in primary custody of two of the three minor children being transferred from the mother to the father, my client. This case involved sophisticated surveillance techniques in order to gather evidence for trial of the mother living with her boyfriend, a convicted felon, despite an earlier order in the case prohibiting her from allowing the children to have any contact with that boyfriend. Earlier divorce litigation involved substantial property and debt issues including the value of a business, tax debts, and innocent spouse issues. The case re-surfaced anew in 2010, on petitions to modify custody and child support, which involved complex financial issues relating to the determination of one of the parties' income, and a settlement in the midst of trial.
Currens v. Perekovic, No. CV 01-5420 (Kootenai County). Three-day trial on behalf of sister against brother for breach of fiduciary duties, fraud and other claims relating to brother's administration of trust set up by their parents. Judgment of several hundred thousand dollars was obtained against the trustee.
Duarte v. Duarte, No. CV 00-5876 (Kootenai County). Recurring custody litigation involving defense against claims of sexual abuse of the parties' minor child, responsive claims of parental alienation, and multiple layers of psychological evaluations and psychosexual evaluations.
In the Matter of the Miles Family Trust, No. CV 02-4528 (Kootenai County). Trust litigation involving interpretation of wording of a trust and competence of surviving spouse to continue to act as trustee. Opposing party's motion for summary judgment was denied, and the matter proceeded to mediation where it was settled.
Ferro v. Solberg, No. CV 94-6273 (Kootenai County). Custody litigation involving many issues over several years but most notable for expert medical testimony (physicians) regarding the father's claim that the child, while in the primary custody of the mother, suffered from a medical condition known as "failure to thrive." This claim was successfully opposed on behalf of the mother.
Toohey v. Beam, No. CV 01-3900 (Kootenai County)(Sealed File). Post-divorce custody litigation on behalf of the mother, involving claims as to the father's parenting and peculiar facts related to his background as former Grand Dragon of the Texas Ku Klux Klan, as author and editor of white supremacist tracts and as frequent speaker at Richard Butler's Aryan Nations Compound (now defunct) in Hayden Lake, Idaho.
Beckwith v. Beckwith, No. CV 95-3381 (Kootenai County). Post-divorce custody litigation on behalf of the mother. As the case went through several contested modification and contempt proceedings over the years, she obtained sole legal and physical custody of the minor children, and later termination of the father's parental rights.
